Withdrawal

§ 1 Withdrawal Notice: a) Right of Withdrawal
The customer has the right to withdraw from his buying contract within 14 days in written form (e.g. letter, eMail, fax) or by sending back the goods without giving any reason. The period begins with receipt of this instruction at the earliest. To meet the cancellation deadline, it is sufficient to send the cancellation or the item in time before the cancellation period has already expired. Der Withdrawal has to be sent to: MaxxTech® Performance, Finkenweg 9, D-74219 Moeckmuehl (Germany).

§ 2 Withdrawal Notice: b) Consequences of Cancellation
In case of an effective revocation, the mutually received services and payments must be refunded within 14 days from the day on which we received notification of your revocation of this contract and any benefits (e.g. interest) that may have been used are to be returned. If the customer cannot return the received goods or service to us complete or partly, or can only return it in a deteriorated condition, he may have to compensate MaxxTech® for the loss of value. This does not apply to the applicant of returned items if the deterioration of the item is solely due to its inspection - as it would have been possible for the customer in a shop, for example. In addition, the customer can avoid the obligation to pay compensation by not using the item like an owner and by refraining from anything that affects its value. Parcel transportable items are to be sent back. You have to cover all direct costs of returning the goods. Items that cannot be sent as parcels will be picked-up from the customer for additional costs. For the repayment we will use the same method of payment that you have used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment.

§ 3 Withdrawal Notice: c) Special Instructions
The customer's right of revocation expires prematurely if the customer's contractual partner has started to perform the service with the proceeding consent of the customer before the end of the revocation period or if the customer has initiated this himself (e.g. by downloading, etc.).
The right of withdrawal does not apply to contracts
a) for the delivery of goods that are manufactured according to customer specifications or that are clearly tailored to personal needs or that are not suitable for return due to their nature or that can spoil quickly or whose expiration date has been exceeded,
b) for the delivery of audio or video recordings or software, provided that the delivered data carriers have been unsealed by the consumer,
c) for the delivery of light bulbs (including LED´s), newspapers, magazines and prints or
d) for the provision of betting and lottery services,
e) for the delivery of NOS items (e.g. stock items that are no longer officially produced or offered by the manufacturer, possibly even if they have already been reduced in price).
